Acceptance of Terms
By accessing or using HostBarrel's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
Services
HostBarrel provides web hosting, VPS hosting, domain registration, and related services. We reserve the right to modify, suspend, or discontinue any service at any time.
Account Responsibilities
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Ensuring your contact information is accurate and up-to-date
- Complying with all applicable laws and regulations
Acceptable Use
You agree not to use our services for:
- Illegal activities or promoting illegal activities
- Distributing malware, viruses, or harmful code
- Sending spam or unsolicited communications
- Infringing on intellectual property rights
- Activities that disrupt or damage our infrastructure
Payment Terms
Services are billed in advance on the cadence shown at checkout. Failure to pay by the due date may result in service suspension and, after a grace period, termination. All fees are non-refundable. You may cancel an active subscription at any time to stop future charges; the service remains available until the end of the period you have already paid for.
Free Website Offer
Where we offer to design and build a website free of charge (the "Free Website"), these terms apply to it in addition to the rest of these Terms.
- What is free. The design and build of one static website of up to five pages with basic functionality, and up to five rounds of revisions. One Free Website per customer, for the customer's own business. It may not be ordered on behalf of, or resold to, a third party.
- What is not free. Online shops, payments, bookings, member logins, integrations, additional pages and any other feature that has to be programmed are custom development. We quote custom development before any work starts.
- Hosting. The Free Website runs on a paid HostBarrel hosting plan with a minimum term of twelve months. The Payment Terms above apply to that plan.
- Revisions. A revision round is one batch of changes to the agreed design. Replacing the design with a different one is a new project. The free rounds end when you approve the website or when the fifth round is finished, whichever comes first. Later changes are quoted before we start.
- Your feedback. You have seven days to respond to each round. A round with no response in that time is closed and counts as one of the five. If we receive no response for thirty days we may close the project. What has been built remains online while your hosting plan is paid.
- Your content. You supply the text, images and logo. We do not write content, take photographs or design logos as part of the Free Website. You confirm that you own or are permitted to use everything you supply, and the Indemnification section applies to it.
- Access and portability. Access to the website files is given once the hosting plan is paid. Parts of the website rely on HostBarrel services and will not work on another provider's hosting.
- Timing. Target dates are estimates. Projects are taken in the order they are confirmed, and we do not guarantee a delivery date.
- No guarantee of results. We do not guarantee search engine rankings, traffic or sales. Domain registration, email accounts and third-party licences are not included.
- Our right to decline. We may decline or stop a Free Website that would breach the Acceptable Use section, and we may change or withdraw the offer for requests we have not yet accepted.
Domain Registration & ICANN Compliance
When you register a domain through HostBarrel, you remain the legal owner (registrant) of that domain. Your name, postal address, and phone number are submitted to the registrar and recorded against the domain.
As part of our managed domain service, HostBarrel acts as your ICANN compliance contact. By registering a domain through us, you authorize and instruct us to:
- Use support@hostbarrel.net as the registrant contact email submitted to the registrar
- Receive and respond to ICANN verification emails (including the mandatory 15-day registrant email verification under the 2013 RAA) on your behalf
- Monitor and act on Whois Data Reminder Policy (WDRP) notices, transfer notifications, expiration warnings, and similar registrar communications
- Forward to you any communication that requires your decision or input
This arrangement exists so that domains do not get suspended because a verification email was missed, marked as spam, or sent to a stale inbox. It does not transfer ownership: you are still the registrant, you may transfer the domain out at any time subject to the registrar's standard transfer rules, and we will release the auth code and lift the registrar lock on request.
If you would prefer to receive ICANN compliance emails directly at your own address, contact us at support@hostbarrel.net and we will update the registrant contact email to one you nominate. You remain responsible for keeping that email reachable; missed verifications can result in domain suspension by the registrar, and HostBarrel is not liable for suspensions caused by unreachable registrant contacts you have nominated.
Renewal reminders, billing receipts, and account-level notices from HostBarrel are always sent to the email address on your HostBarrel account, regardless of which email is set as the registrar contact.
Service Level Agreement
Our uptime guarantee and service credits for hosting services are set out separately in our SLA Agreement, which forms part of these Terms.
Copyright & DMCA Policy
We respect the intellectual property rights of others and expect our customers to do the same. If you believe content hosted on our services infringes your copyright, send a notice to support@hostbarrel.net including: (1) identification of the copyrighted work; (2) identification of the material you claim is infringing and its location; (3) your contact information; (4) a statement that you have a good-faith belief the use is unauthorized; and (5) a statement, under penalty of perjury, that the notice is accurate and you are authorized to act on the copyright owner's behalf. We will remove or disable access to material in response to a valid notice and notify the affected customer, who may submit a counter-notice as provided by applicable law. Repeat infringers are subject to account termination.
Indemnification
You agree to indemnify and hold HostBarrel harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of our services, the content you host, or your violation of these terms.
Limitation of Liability
HostBarrel shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services.
Termination
We may terminate or suspend your account for violation of these terms. You may cancel your account at any time through your control panel or by contacting support.
Governing Law & Dispute Resolution
These Terms are governed by the laws of the jurisdiction in which HostBarrel is registered, without regard to conflict-of-law principles. Any dispute arising from these Terms or our services will first be addressed through good-faith negotiation by contacting support@hostbarrel.net; if unresolved, it will be subject to the exclusive jurisdiction of the courts of that jurisdiction.
Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date; continued use of our services after changes take effect constitutes acceptance of the revised Terms.
